SS501′s Park Jung Min Wins Case Against Agency for Cancellation of Contract

The court ruled in favor of Park Jung Min in his case against his agency CNR Media.

The decision came on July 30. As such, Park Jung Min will now be able to promote in Korea and overseas regardless of his contract with CNR Media until the judgment on merits is issued.

In October 2010, Park Jung Min had signed a three year contract with CNR Media, a joint venture between Taiwanese and Korean companies. During his overseas promotions after his solo comeback, however, he filed for a cancellation of his contract in April 2012.

Park Jung Min asserted in his case against CNR Media that “(1) Despite that CNR Media had to balance all incomes earned through the exclusive contract within 20 days they were received, the company did not go through with its duties other than partial advance payments and (2) Despite that it had to provide documented evidence of the balanced incomes every time, it only did so a year after the contract had been signed, and even then the documents omitted earnings, overcalculated deductions and failed to attach reference materials. This is why the contract was cancelled in December 2011.”

The justice department recognized the truth in all of his assertions, and thus had the contract suspended.

It found that if the contract was continued, Park Jung Min would be harmed beyond recovery, and would be hindered in his freedom to choose his job as a celebrity.

Park Jung Min’s attorney, lawyer Huh Jong Sun, said on the decision, “This decision showed that although the contract between the celebrity and agency itself was fair, it may be cancelled if the agency doesn’t play its part in distributing the earnings or balancing the income based on the contract. It means a lot to the common custom of putting off income balance and distribution in showbiz. With this decision, Park Jung Min can be active in Korea and overseas until his own trial.”

Even while going on with the trial, Park Jung Min continued to uphold his promise with his fans, attending all schedules set by CNR Media including promotions for the Taiwanese drama Sugarcake Garden.
